CORRUPTION IN WATER SECTOR: STRATEGIES IN PREVENTING CORRUPTION
Corruption in the water industries comes in many different forms and the scope varies substantially across types of water practices, governance structure and the perceptions and norms of actors involved. Typical examples of corruption include falsified meter reading, distorted site selection of boreholes or abstraction points for irrigation, collusion and favoritism in public procurement, and nepotism in the allocation of public offices.
From 1st June 2019, companies (not just individuals) and directors will be prosecuted for corruption. Companies are now required to create policies and efforts to prevent corruption. If an employee, or a person associated with the company is found to commit a corrupt act to enable the company to acquire or retain a contract or interest, companies and their directors could be prosecuted under Section 17A.
Section 17A(2) provides that the penalty for an offence under Section 17A shall be a fine of not less than ten times the value of the gratification in question or RM 1 million (US$247,300), whichever is higher, or imprisonment for not more than 20 years, or both.
Good governance is recognized as the first line of defense against corruption. Therefore, the water sector have to devise strategies to address and manage corruption risks effectively and proactively. The comprehensive framework will enable corporate bodies to take up the challenge of building a corruption resistance company, reinforce their own objectives and enhance stakeholder trust in their organizations.
This talk will focus on issues and impacts corrupt practices in relation to the water sector. Participants will be guided in strategies to curb corrupt practices towards achieving certification ISO 37001 (Anti Bribery Management System).
Dr. Azmi Bin Hj. Mohd is the Research Fellow in School of Management Asia e University and Consultant in IMC Solution (Integrity Management and Consultancy). He is a former Senior Assistant Commissioner of Malaysian Anti-Corruption Commission (MACC). Besides of being Certified in Corruption Investigation Activities and Certified Training the Trainer, Dr. Azmi possesses a Doctorate in Business Administration from Universiti Utara Malaysia (Northern University of Malaysia) specialized area in transformational leadership and governance. He is also Member of Board Director in iFree Group Security (Malaysia) and Board of Governance of Protemp Group (Malaysia).
Currently, he was also as part-time lecturer in Universiti Utara Malaysia (UUM) teaching Managing Ethics, Subject Matter Expert (SME) in Business Ethics and Corporate Governance with Australia-New Zealand Institute (ANZI) and Malaysia Institute of Management (MIM). With 26 years working experiences in MACC, Dr. Azmi being presented papers (representing MACC) on corruption related topics at international level in different countries including India, Thailand, Brunei, Taiwan, Cambodia and Singapore organized by UNODC (United Nation Office on Drugs and Crimes) and SEAPAC (South-East Asia Parties Against Corruption).
As a subject matter expert during his tenure with MACC in transnational bribery and forensic integrity based- leadership, Dr. Azmi has been invited as guest speaker in these area to several government ministries, agencies and government link companies. His leadership with MACC in investigation, prosecution, prevention, transnational bribery, and issues on managing integrity made him an expert in corruption crime investigation, transnational investigation and prosecution, corruption risk management/assessment, forensic integrity-based leadership, laws on corruption, organizational business ethics, integrity compliance, and corruption strategic management.
He also has published international academic journal on the topic “The Implication of Transformational Leadership Style, Organizational Commitment, and Teamwork Performance among Law Enforcement in Malaysia”.
